How to Exit Debt Review

To leave Debt Review, a court must say that the person is no longer over-indebted. Even if no court order was made at the start, only a court can decide if the person can exit the process.​

The person must show proof (like an affidavit) that they can now afford to pay their debts.​

When Can You Leave Debt Review?

You can leave Debt Review only when:​

  • You have paid all your debts (according to the new plan), and​
  • You receive a Clearance Certificate from the Debt Counsellor.​

Can a Debt Counsellor End the Process?

No. A Debt Counsellor cannot end the Debt Review process. They also cannot use the old Form 17.W to remove someone from the system.​

Can You Cancel Debt Review After a Court Order?

If the court already approved a Debt Counselling Order, you cannot cancel the process on your own. But you can ask the court to cancel (or rescind) the order if you are no longer over-indebted. If the court agrees, your Debt Counsellor will inform your Credit Providers using the correct form.​

You can only stop the Debt Review process before the court or Debt Counsellor says you are over-indebted.​

Cancelling the Debt Review Agreement

You can cancel the agreement within five business days of signing it, with no cost. If you already paid money, it will be refunded.​

What Do You Need to Apply for Debt Review Removal?

To apply to be removed from Debt Review, you must give these documents:​

  • A copy of your ID​
  • Your latest payslip​
  • Your bank statement​
  • Form 17.W (if you have it)​
  • A list of all your creditors (people or companies you owe money to)​
  • A Court Order from the Administrator (if you were under administration)​

Important: When Can You Be Removed from Debt Review?

You can only be removed from Debt Review if:​

  • The court did not make a Debt Restructuring Order saying you are over-indebted.​
  • If the court did make an Order, you must first pay off all your debt and get a Clearance Certificate from your Debt Counsellor.​
  • This means not everyone can be removed from Debt Review. Always check with your Debt Counsellor to understand your options.​
